Rules and regulations of "Kerala State SC & ST Residential Educational Society"
  I. Name of the Society: The name of the society shall be "The Kerala State SC&ST Residential Educational Society" herein after referred to as the "Society".
  II. Definitions
  (a) Government Body meads the body constituted under rules VII of these rules and regulations.
  (b) "Schools" means the Kerala State SC/ST Resident ional Educational Schools/Ashram Schools/Preprimary Educational Institutions established /adopted/managed by the Society.
  III Location of the office: The registered office of the society shall be situated at Thiruvananthapuram. The main office of the society will be situated at the office of the Director of Scheduled Tribes Development department, Thiruvananthapuram.
  IV Jurisdiction: The Society shall have the state wide jurisdiction.
  V Aims and objection: The objections of the society shall be.
 
a)   to establish, maintain, control and manage all types of Educational institutions for the Scheduled Caste and Scheduled tribes in the State and to do/acts and take steps necessary for or conductive to promotion and development of such institutions.
 
b)    to adopt, manage and promote the Residential Schools/Ashram School/pre-primary Educations Institutions and Collegiate Educations institutions for Scheduled Caste and Scheduled Tribes run by the State/SC & ST Development Department as on the date of formation of the society and would be started in future and to preserve, utilize and control the assets and funds of the Government associated with these institutions transferred to the society for the purpose.
 
c)   to organize and conduct study course, special coaching facilities conference, lectures, seminars, workshops, study tours and the like for the benefit of the staff and students of the institutions under the society.
  d)   to promote sports& games, cultural and educations ,reserach and other extra curricular activities for the development and for SC&ST student in general.
  VI Membership
 
a) The Society shall have as its member all the persons on the Government Body and such other officers working in SC&ST Development Department as the Government of Kerala in the Scheduled Caste & Scheduled Tribes Development Department from time to time admit any nomination to the members of the society.
  VII) Government Body
     The management of the Society shall vest in a Government Body Consisting of Ex- officio Members and nominated members as shown below:

  VIII. Powers and function of the Governing Body.
  a) It shall be responsible for the overall functioning of the society to determine and implement its policies subject to general supervision and approval by the Governing Body.
  b) to approve the expenditure statement of the previous year.
  c) to pass the budget for ensuing /current year
  d) to elect the Executive Committee
  e) to make /amend bye-laws to carry out objectives of the society as laid down in the memorandum of association.
  f) To appoint Chartered Accounts to audit the accounts of the society every year
  g) To discharge any other functions required for the smooth functioning of the society which will not come within the domain of the Executive Committee
  h) It shall have the powers to appoint refresh or otherwise deal with the employees of the society including dismissal.
  i) It shall have the authority to raise resources for the society by way of fees, donations, grants etc. from Government Public or Private bodies, individuals etc. The society can open joint account in the name of President and Treasurer.
  j) It shall have the authority to co-opt outsiders to serve the society in such a manner as it consider fit.
  k) It shall determine the producers for conduct of the work of the society.
  m) It shall have authority to use and be used in the name of the society in the discharge of the functions and obligations of the society.
  IX. President.
     The president will preside over the meetings of the Governing Body.He may delegate any or all his powers temporarily to one of the Vice-presidents. The president shall have the powers to reject, modify or amend any decisions taken by the Executive Committee.
  X. Vice -President
     The Vice President nominated by the president will preside over the meetings of the Government Body in the absence of the President. He would be the Chairman of one of the district level Executive Committee.
  XI. Secretary-cum-Treasurer
 
   The Secretary will be the Chief-Executive of the Society and he will have all the powers to carry out the decision of the Governing Body. All the monetary transactions of the society will be made by or on the prior approval of the Soceity. In the time of urgency, this came be done with the approval of president and placed for the ratification of Governing Body. The Secretary at the behest of the President will call the meeting of the Governing Body. He will cause to place reports of all activities of the society at every meeting of the Governing Body and annual reports at the annual meeting of the Governing Body.He will primarily be accountable for all the activities of the society.
  XII. Funds
     Funds of the soceity shall be spent for the attainment of the objectives of the Soceity and no portion of it should be diverted for any other purpose.
 
XIII. Executive Committee
     There would be an Executive Committee in each District where the Residential Schools /Ashram Schools/Pre-primary Educational Institutions under the Control of the Society are situated.
  It shall consist of the following:-
 
i) Chairman : District Collector who is also one of the Vice President of the Governing Body
ii) Vice- Chairman : As nominated by Chairman in his absence
iii) Convenor
Project Officer/Tribal Dept.Officer of Sch.Tribesdevelopment Dept. in whose jurisdiction of the school is situated.
iv) Treasurer Principal/Head Master of the concerned schools
v) Members
a) Joint Director Sch.Tribes Dev.Dept
b) Deputy Director of Education
c) District Educational Officer
d) District Medical Officer
f) District Development Officer,sch.Caste Development Dept.
g) A member from the Teaching Staff.
   
  XIV. Powers of the Executive Committee:
  a) It shall such powers and functions as delegated by the Governing Body.
  b) It shall act for promotion of the objectives of the Society in all possibleways.
  c) The Executive Committee shall look after the day to day functions of the society, institutions under the society and shall provide necessary guidance to the Joint Secretary/Treasurer of the Executive Committee in discharging his/her functions.
  d) Executive Committee shall ensure the proper and efficient functioning of the institutional under them subject to the decision and directions given by the Governing Body
  e) Executive committee will exercise immediate disciplinary powers over the employees of the society and the institution under the society.
  f) All accounts vouchers, transactions of the Executive Committee and the institutions under the Executive Committee would be approved and scrutinized by the Executive Committee.
  g) Open Bank Accounts in the Joint name of convener and treasurer.
  XV) Powers and functions of the Convenor of the Executive Committee.
  a) The Convenor shall be responsible for the day-to-day administration of the Educational institutions functioning under the society
  b) The Convenor shall perfrom all his duties and functions accordance with the Rules and Regulations of the Society and decisions and directions of the Executive Committee and Governing Body.
  c) The convenor shall be responsible for the preparation of minutes of the Executive Committee and to take action on various decision of administrative nature and also to report the action taken in the subsequent meetings.
  d) The convener shall represent the society in all legal proceedings, contracts and agreements and appear before any court of law on behalf of the Executive Committee as and when required.
  e) He shall issue a;; correspondence, orders, proceedings etc, on behalf of the chairman on the Executive committee.
  XVI) Powers and functions of the Treasurer of the Executive Committee
     The treasurer shall be responsible for the day to day function of the institution and proper maintenance of Accounts, financial statement and other financial document of the Institution. He shall be responsible for the observance of rules and regulations related to financial matters of the society. He shall bring to the notice of the ExecutiveCommittee of the President, any instances of violations of such regulations.
  XVII Properties of the Soceity
     All the properties belonging to the society shall be deemed to be vested in the Governing Body of the society but shall be referred as the "property of the society"
     The Society may sue or may be used in the name of the President or Secretary or any office bearer authorized by the Executive Committee in this behalf.
 
a) No suit or proceedings shall abate by reason of any vacancy or charge in the holder of any office in the executive committee of the society.
 
b) Every degree/order against the society in any suit or proceeding shall be executive against the property of the society and not against the persons or property of the president, the society or any office bearer.
 
c) Nothing in such selection(b) above shall exempt the president the secretary or office bearer of the society from a criminal liability or entitle him to claim any contribution from the property of the society in respect of any fine paid by him or conviction by any criminal court.
 
XVIII) Every member of the soceity may be sued or prosecuted by the society for any lose or damage caused to the society or its property or for anything done by him detrimental the interest of the society
 
XIX) Every member of the Governing body shall have right of inspection of the accounts and registers maintained by the society and proceedings of the meeting of the society at any time during office hours.
  XXI) Governing body resolution and its decisions shall adopted by the ,a majority of the members present and voting.
 
XXII) The Governing Body meeting shall be convened by giving 7 days notice to the memebers or any notifying the dates of the meeting in any major local newspaper 7 days prior to the dates of meeting. On specially urgent occasions the president may cause the secretary to call the meeting of the Governing Body on short notice by waiving seven days notice.
 
XXIII) Each member of the Governing Body will have one vote on any question to be decided in the respective meetings and in the event of equality of votes, the president will have the casting vote.
 
XXIV) The Governing Body shall meet at least once in the quarter year or on such occasion the Governing Body deems it necessary or when requisitioned by at least 1/3rd of the total members. Executive Committee will meet once in every three months and as frequency as required the chairman can call the meeting at short notices. The annual general body of the society shall meet in a financial year.
 
XXV) Bye-laws: The Governing Body shall have the powers to make the bye-laws in consisted with the objectives, rule and regulations of the society or attaining the objective of the society and to carry on the day to day administration of the society
 
XXVI) Amendment: No amendments or alternations be made in the memorandum of the society unless it is approved in a meeting of the Governing Body specifically called for the purpose and attended to by not less than 2/3rd of the members of the society provided the Governing Body will not take up any amendment which aims at altering the basic character and structure of the society.
 
XXVII) Winding up: In case the society has to be wound, the funds of the society that remain after full satisfaction of the liabilities of the society, shall be paid to Government or to some other institutions with similar objectives with the prior approval of the Government .The assets transferred by Government would be transferred to Government without any liability in the event.
